This talk will describe in broad strokes the legal scheme that applies to research in the United States. Next, it addresses the risks to research subjects when data is repurposed, when it is potentially reidentifiable, and when researchers use surreptitious interventions. Prof. Bambauer will argue that these risks are not as severe as they are often presumed to be. The talk will conclude with an examination of the incentives that are created by current and proposed laws restricting research.
