Arizona Court of Appeals, Division II to Hold 2023 Court Session at University of Arizona Law

As part of its ongoing public education effort, Division Two of the Arizona Court of Appeals will hold oral arguments during a special court session at the University of Arizona James E. Rogers College of Law on March 28.  

When: Tuesday, March 28, 2023, 1:30 PM to 4:00 PM MST 

Check-in for Case One starts at 12:45, and check-in for Case Two starts at 1:45. 

Where: University of Arizona James E. Rogers College of Law, 1201 E. Speedway Blvd., Room 164 (Ares Auditorium). Livestreaming will not be available for this event. 

Who may attend: Seating is available to those who have registered prior to the event. Members of the public are welcome on a first-come, first-served basis as remaining space allows.     

Note that food and beverages are not permitted past security. 


Case One (2 CA-CV 2022-0071), 1:30-2:20 p.m. 
Crown Engineering Services v. Sundt Construction and Kiewit Corp. 

In this breach of contract action arising from a road construction project, the trial court determined there was sufficient evidence Sundt Construction and Kiewit Corporation breached the contract but no evidence that Crown Engineering Services suffered any resulting damages and granted summary judgment to Sundt and Kiewit. Was summary judgment appropriate?  

Case Two (2 CA-CR 2020-0131), 2:30-3:20 p.m.  
State of Arizona v. Charles B. Beeler 

Beeler appeals from his convictions and sentences for two counts of sexual conduct with a minor, arguing the trial court lacked jurisdiction, erred in its admission and preclusion of certain evidence, and made inadequate factual findings to support his two sentences of life in prison. He also argues the state committed multiple acts of prosecutorial misconduct, thereby depriving him of his constitutional right to a fair trial.
