As part of its ongoing public education effort, the Arizona Court of Appeals, Division 2, will hold oral arguments during its annual visit to Arizona Law. The court visit is hosted by the College of Law's William H. Rehnquist Center on the Constitutional Structures of Government.
Seating will be available first to those who have registered. Others are welcome to observe on a first-come, first-served basis as space is available.
CASE 1: 1:30-2:20 p.m.
2 CA-CR 2023-0168 – State of Arizona v. Christopher Wayne Cooker
Summary: On appeal from his convictions and sentences for aggravated driving under the influence and aggravated assault, Christopher Cooker argues the trial court violated his constitutional rights to confrontation, to a twelve-person jury, and to notice of the charges against him.
CASE 2: 2:30-3:20 p.m.
2 CA-CV 2023-0293 – Jane Doe I & II; John Doe v. The Corporation of the President of the Church of Jesus Christ of Latter-Day Saints, et al.
Summary: On appeal from the trial court’s entry of summary judgment in favor of the Church defendants, the Does argue summary judgment was inappropriate because the presence of non-clergy individuals during confidential communications was behavior inconsistent with maintaining confidentiality, constituting waiver of the clergy-penitent privilege and, thus, requiring the Church defendants to report child abuse under A.R.S. § 13-3620(A).
Additional Information About This Event
When registering, you will be able to choose whether you want to observe Case 1, Case 2, or both cases. A break will follow Case 1 so that those audience members unable to attend both arguments may transition in and out of the courtroom.
A question-and-answer period will follow Case 2. At this time, the judges will take questions from the audience, though they will be unable to discuss anything related to either case just argued.
Check-in for Case 1 starts at 12:45, and check-in for Case 2 starts at 2:00. There is no courtroom entry once court is in session. Attendees who leave the courtroom must go through security again to reenter.
Important: Photo ID required for courtroom entry. All attendees will go through a security screening. No backpacks, purses, or electronic equipment are permitted in the courtroom. We cannot offer secure storage for your belongings, so please make arrangements ahead of time. Phones are permitted in the courtroom but must be turned off. No food or drink allowed. Professional dress strongly encouraged. No t-shirts, shorts, hats, sunglasses, or flip flops permitted.
