Arizona Court of Appeals to Hear Criminal, Civil Cases in Special Session at University of Arizona Law

As part of its ongoing public education effort, Division Two of the Arizona Court of Appeals will hold oral arguments during a special court session at the University of Arizona James E. Rogers College of Law. 

The judicial visit is hosted by the college’s William H. Rehnquist Center.  

When: Wednesday, Feb. 28, 2018,1:30-4 p.m.

Criminal Case: The State of Arizona v Porfirio Medina

Case Summary: Defendant, Porfirio Medina, was convicted of illegally possessing a gun based on a his status as a convicted offender. At trial, he attempted to present evidence that he possessed the gun because of threats he faced from gang members.  In essence, his claim was that he was justified in possessing the gun to protect himself. The trial court precluded this argument because Medina did not provide the prosecutor sufficient notice of this justification defense in advance of trial. The appellate court will determine whether preventing Medina from presenting this defense violates due process.

Civil Case: Freeport Minerals Corp. v The Arizona Corporation Commission

Case Summary: This case involves a direct appeal by Freeport Minerals Corporation of a decision by the Arizona Corporation Commission setting rates for Tucson Electric Power. Freeport contends that the decision requires it to subsidize residential customers in violation of Arizona law. Tucson Electric Power is an Intervenor in the case.
