The Journal of Appellate Practice and Process Publishes Summer 2023 Issue

The University of Arizona James E. Rogers College of Law and the National Institute for Trial Advocacy have released the Summer 2024 issue of The Journal of Appellate Practice and Process (Volume 24, Issue 2). This issue features articles on the work of state courts.   

Journal Editor-in-Chief and contributor Tessa L. Dysart said, “This issue highlights the important work done by state appellate court judges nationwide. The federal appellate courts often receive significant media coverage, especially this time of year, but nationwide there are 50 state supreme courts and nearly that many state intermediate appellate courts issuing impactful decisions. My goal for this issue was to recognize and honor the role of state courts in our judicial system.” Dysart serves as the assistant director of legal writing and clinical professor of law at University of Arizona Law. 

The issue opens with an essay in memory of the late United States Supreme Court Justice Sandra Day O’Connor written by University of Arizona Law Dean Emerita and Regents Professor Toni Massaro. It concludes with an innovative project—undertaken by two school-age children—to expose children to the judiciary through video interviews with members of the Texas Supreme Court. The article is written and video interviews conducted by James Caughey and Emily Caughey, children of Jennifer Caughey, former justice of the Texas First Court of Appeals. 

Other topics in the summer issue include the standard of appellate review for audio and video recordings presented at trial, the impact of a legislative change that allows the North Carolina Court of Appeals to sit en banc, best recommendations for writing briefs for expert readers, the historic role of the Reporter of the United States Supreme Court decisions and challenges facing the current Reporter, a proposal for a new structure for appellate opinions, and a review of an updated handbook for moot court advisors.   

In addition to Massaro and the Caugheys, contributors include Jeffrey M. Anderson, Samford University Cumberland School of Law; Hon. Allegra Collins, North Carolina Court of Appeals; Hon. Lacey Stover Gard, Arizona Court of Appeals; Lisa Howell, Arizona Court of Appeals; Hon. Eric J. Magnuson, formerly of the Minnesota Supreme Court; Peter W. Martin, Cornell Law School; Hilary Stirman Reed, University of Houston; and Hon. Samuel A. Thumma, Arizona Court of Appeals.
